Subpoena Tab

Overview

Click the Subpoena tab to display the subpoena activity in a given matter. From this tab, you can create, save, fax, print, schedule, docket, e-mail and track all subpoena, as well as, print envelopes and service lists.

  • Date. The date the appearance for the subpoena is set for.
  • Return Date. The date service was returned.
  • Time. The time the appearance for the subpoena is set for.
  • To. The name of the individual to whom the subpoena is addressed.
  • Canceled. If checked, indicates that the subpoena has been canceled.
  • Canceled By. If the subpoena was canceled, indicate that the name of the individual who canceled the subpoena.
  • Link. A hyperlink that is created when the subpoena document is generated.
  • Imaged Sub. A link to view an embedded image of the subpoena. Click the link to view it. To add an embedded object, see “Embedding Scanned Images, Video or Audio Clips in Case Records.”
  • Description. The description of documents for the subpoena.
  • Party. The name of the party generating the subpoena.
  • Location. Information regarding exactly where the appearance for the subpoena is to take place.
  • Service. A link to display an embedded copy of the Notice of Service. Click the link to view it. To add an embedded object, see “Embedding Scanned Images, Video or Audio Clips in Case Records.”

Creating a New Subpoena

  • Ensure that the required information has been entered on the Caption tab (Plaintiff, Defendant and Court Title). (For instructions, see “Working with the Caption Tab”).
  • Click the Create New button on the task bar at the bottom left of your window. The Subpoena Detail window appears.
  • Enter any required information.
  • Date/Time. Enter the date and time for the appearance for the subpoena. Change the date if necessary, as described in “Entering Time and Dates.”
  • Author. The name of the individual signing the subpoena. Pick the name from the drop-down list.
  • Link. A hyperlink that is created when the subpoena document is generated.
  • Party. The name of the party is created for.
  • Duces Tecum Description. The description of the documents or records being requested.
  • To. The name of the individual or entity to whom the subpoena is being sent. If the individual is not listed in the drop-down list, use the Pick from a List of Previously Entered Contacts button to choose the name of the individual already entered in TrialWorks or use the Create New Contact button to add a new record.
  • Category. The templates category to limit the list of templates.
  • Template. The list of available templates used to create the subpoena.
  • Location. The location where the Duces Tecum documents or the person/entity should respond to the subpoena.
  • Client. If necessary, select the name of the client from the drop-down lists, so that their information will appear in the document.
  • Other Parties. If necessary, select the name of the other party from the drop-down lists, so that their information will appear in the document.
  • Fax Info.
  • Faxed Checkbox. Click this checkbox if the document was faxed to the recipient.
  • Faxed To. The name of the individual who the document was faxed to.
  • Date Faxed. The date the document was faxed.
Click the Create Subpoena Notice button.
TrialWorks creates the subpoena notice using the word processor template you selected and opens the document. Edit the notice as required, then exit the word processor to return to the Subpoena Detail window.
Click the Exit button to return to the Subpoena tab.

The new subpoena is now a hyperlinked document that you can click to view, edit, or print as you normally do in your word processor.

Editing or Printing a Subpoena

  • Click in the Link column for the subpoena.
  • Edit or print the subpoena as you normally do in your word processor.
  • Close the subpoena.

Remove an entry from the Subpoena Tab

  • Select the entry by highlighting the row and click the Delete button on the bottom toolbar.

E-mailing a Subpoena To a Recipient Inside the Firm

  • Select the subpoena to e-mail.
  • Click the E-mail button.

The message window appears with a shortcut to the subpoena attached to the message. The shortcut is a direct link to the subpoena notice stored on the shared drive.

  • Address and send the message.


E-mailing a Subpoena to a Recipient Outside the Firm

  • Select the Subpoena to e-mail.
  • Right-click on the link. Choose to “Send File as Attachment”.
  • A window appears for all contacts from the current case with e-mail addresses. Choose the recipient or click on Continue to send to another recipient not listed.
  • The message window appears and a copy of the discovery is attached. The item is addressed if a recipient had been chosen.

Calendaring a Subpoena to the Docket Tab

  • To create a calendar entry for the subpoena, highlight the entry and click on the TW Docket button.

The Docket Tickler window appears.

  • Click the checkbox to add the entry to the Reminder list.
  • Enter the number of Days before the subpoena is due for the reminder to appear.
  • Enter the name of the individual Assigned To preparing or responding to the Subpoena.
  • Enter the name of the individual in the Assigned By field who assigns the preparation or response to the Subpoena.
  • Modify the description as necessary. The description of the document will automatically be included in the description field.
  • If you want TrialWorks to automatically calculate the number of days the item is due, enter the number of days in the Auto Calculate Tickler for Docket: Days from Date above field.
  • Click the Add Tickler from Date Selected to Docket to add the entry to the Docket Tab from the selected date; or click the Auto Calculate Tickler for Docket.
  • Once the entry has been added to the Docket a window will appear asking the user “Do you Want to Add this Entry to the Calendar”?
  • Click Yes and an Appointment window appears allowing the user to add the entry to your Outlook or GroupWise Calendar.

NOTE: Use Auto Days and Quick Fill to automatically have the number of days the item is due or the description filled in.

Calendaring a Subpoena

  • To create an appointment related to a subpoena, select the subpoena.
  • Click the Calendar button.

The appointment window appears.

  • Schedule the appointment.

Creating a Task for a Subpoena

  • To create a task related to a subpoena, select the subpoena.
  • Click the Task button.

The task window appears.

  • Schedule the task.
